Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Eli Marco website and services (collectively, the "Services") operated by Eli Marco Ltd ("Eli Marco", "we", "us").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you may not access or use the Services. These Terms form a legally binding agreement between you and Eli Marco.

Eligibility

By using our Services, you confirm you are at least 18 years of age and have the legal authority to enter into this agreement. If acting on behalf of an organisation, you confirm you have authority to bind that organisation to these Terms.

Use of Services

Eli Marco grants you a limited, non-exclusive, non-transferable, revocable licence to access the Services for your lawful internal business purposes. This licence does not permit you to:

  • Reproduce, distribute, or create derivative works from any part of the Services
  • Reverse engineer, decompile, or disassemble any component of the platform
  • Use the Services to develop a competing product or service
  • Share access credentials or allow unauthorised third-party access
  • Use the Services in any manner that violates applicable laws or regulations

Demo Requests

Submission of a demo request form does not constitute a binding contract for services. It represents an expression of interest. Eli Marco reserves the right to accept, decline, or postpone any request at its sole discretion.

Eli Marco's Services are subject to applicable export control laws and regulations. By accessing the Services, you confirm you are not a prohibited party and that your use complies with all relevant legislation.

Intellectual Property

All intellectual property in and relating to the Services, including EraFrame™, platform architecture, algorithms, methodologies, software, design, trademarks, and documentation, is and shall remain the exclusive property of Eli Marco.

Nothing in these Terms transfers or grants any ownership rights in our intellectual property. Any feedback or ideas you submit may be used by Eli Marco without restriction or compensation.

"Eli Marco", "EraFrame", and associated marks are trademarks of Eli Marco Ltd. You may not use them without our prior written consent.

Confidentiality

Aspects of our technology, including EraFrame™, constitute proprietary and confidential information. Any non-disclosure agreement entered into in connection with a demonstration or deployment forms part of these Terms by reference. You agree not to disclose such information to any third party without our prior written consent.

Liability & Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for purpose, or non-infringement.

To the maximum extent permitted by applicable law, Eli Marco shall not be liable for any indirect, incidental, special, consequential, or punitive damages, even if advised of the possibility of such damages.

Eli Marco's total aggregate liability shall not exceed the greater of (a) the amount paid by you in the preceding twelve months, or (b) one hundred pounds sterling (£100).

Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Modifications

We may modify these Terms at any time. Material changes will be noted by updating the date above. Continued use constitutes acceptance of the revised Terms.

Privacy Policy

Eli Marco is committed to protecting the privacy of individuals who interact with our Services. This Policy explains how we collect, use, and protect personal information under applicable data protection law, including the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

Eli Marco Ltd is the data controller responsible for personal data processed through this website and associated Services.

Information you provide directly

When you submit a demo request, we collect:

  • Name (first and last)
  • Work email address
  • Organisation name and your role or title
  • Sector information
  • Any message or description you voluntarily provide

Information collected automatically

When you visit our website, we may automatically collect:

  • IP address and derived geographic location
  • Browser type, version, and operating system
  • Pages visited, time spent, and referral source
  • Device type and screen resolution

We do not sell, rent, or trade your personal data with any third parties for their marketing purposes. Your information is handled with the same rigour we apply to our clients' operational data.

How We Use Your Data

Legitimate Interests

We process personal data submitted via demo requests to respond to your enquiry, assess product fit, and facilitate an initial conversation. We have conducted a legitimate interests assessment and determined this does not override your rights.

Legal Obligation

We may process personal data to comply with applicable laws, court orders, or regulatory requirements including export control screening and sanctions compliance.

Specifically, we use your data to:

  • Respond to and manage demo requests and enquiries
  • Conduct internal screening in compliance with applicable laws
  • Improve our website through aggregate, anonymised analytics
  • Protect the security and integrity of our platform

We will not use your data for automated decision-making or profiling that produces legal or significant effects on you.

Security & Retention

We implement appropriate technical and organisational measures to protect personal data against unauthorised access, disclosure, alteration, or destruction. Measures are reviewed and updated in line with security best practice.

We retain personal data only as long as necessary for the purposes collected, or as required by law. Demo request data is typically retained for up to 24 months from submission, after which it is securely deleted or anonymised.

While we take data security seriously, no internet transmission is completely secure. We cannot guarantee absolute security, but will notify you and relevant authorities of any breach as required by law.

Under UK GDPR, you have the following rights:

  • Right of access: obtain a copy of your personal data
  • Right to rectification: correct inaccurate personal data
  • Right to erasure: request deletion where applicable
  • Right to restrict processing: limit how we use your data
